Effective August 2010. The following fee schedule is for two (2) party mediations. For mediations involving more than two (2) parties there is a flat rate of $450 per additional party added. Fees are billed to Counsel equally unless otherwise notified. MEDIATION SERVICESNational Capital RegionFull Day - $4,000.00 Kingston - Toronto - GTA - Kitchener - Oakville - Hamilton - Niagara - Barrie - Collingwood - Owen SoundFull Day - $4,400.00 London - Windsor - Sarnia - Northern OntarioFull Day - $4,000.00 plus actual travel and accommodation cost These fees include case administration, pre-mediation preparation and consultation, travel time, mediation conference time (Full day: 6 hours. Half day: 3 hours) and reporting. Additional mediation conference time is charged at $450 per hour, or part thereof. Facilities costs, when required, are in addition to the foregoing fees. ARBITRATION SERVICES$500 per hour, plus actual travel and facilities costs HSTHST is charged in addition to all fees when required by law. Cancellation PolicyIf a mediation or arbitration is cancelled or postponed at the request of any party for any reason, all fees and disbursements incurred to that point shall be paid by the Party requesting the cancellation or postponement. If cancellation or postponement occurs within 1 calendar month of the event, the cancellation fee is $1,500 per day cancelled in addition to all disbursements incurred to that point for travel, accommodation and facilities that cannot be mitigated . If cancellation or postponement occurs within 14 calendar days of the event, the cancellation fee is the full fee for the day cancelled in addition to all disbursements incurred to that point for travel, accommodation and facilities that cannot be mitigated. Cancellation fee will be reduced by any and all fees earned on other matters for the day cancelled. PaymentFor mediation and arbitration services accounts are divided equally among the parties and are addressed to the lawyers representing the parties unless alternative arrangements are made in advance. If the case involves an unrepresented party or parties then a deposit equal to that party's or parties' share of the total estimated account must be received at least 10 business days prior to the mediation unless alternative arrangements are made in advance. All accounts are due and payable when rendered. Overdue accounts bear interest at 10% per annum, calculated and payable monthly. |
